Terms of Service

1. Introduction

These Terms govern your use of trackpetition.com (the "Service"), operated by Startup58 LLC. By using the Service, you agree to these Terms.

2. Eligibility

You must be at least 18 years old to use the Service. You represent that you have legal capacity to agree to these Terms.

3. Account registration

When the Service launches:

  • An account requires a valid email address.
  • You must maintain credential confidentiality.
  • You must notify us immediately of unauthorized access.
  • One account per person.
  • You must provide accurate, complete information.

4. The Service

trackpetition.com is a service that monitors a subscriber's USCIS case and notifies them through the channels you choose — WhatsApp, Telegram, email, and browser push — when the case status changes, for any visa type. A free case-status check is available to anyone; the paid monitoring subscription launches Q3 2026.

The Service is not:

  • Affiliated with USCIS or any government agency.
  • A legal advisory service.
  • A substitute for an immigration attorney.
  • A means to submit applications to USCIS.
  • A guarantee of any specific outcome.

5. USCIS data and compliance

At launch, we will access USCIS case status through the official Developer Portal API integration. Production access is being provisioned; pre-launch lookups run against the USCIS sandbox. We will operate in compliance with the USCIS Terms of Use for the Online Electronic Immigration System.

We do not:

  • Submit applications to USCIS on behalf of users.
  • Provide legal advice.
  • Represent users in immigration matters.
  • Bypass USCIS systems or access controls.
  • Use unauthorized third-party software.

Notifications are best-effort, not guaranteed

A TrackPetition alert depends on USCIS publishing the status change on their systems and on our automated checks and message delivery (WhatsApp, Telegram, email, browser push). Either can be delayed or fail — due to USCIS outages or changes, provider or network issues, or maintenance. We re-check your case multiple times per day on a schedule, so an alert may lag the actual change and, in rare cases, may be missed or duplicated. TrackPetition is a convenience tool, not an official channel — always verify important updates directly with USCIS. Our alerts are informational only and do not constitute legal notice of any USCIS action, decision, or deadline. To the extent permitted by law, we are not liable for delayed, missed, or duplicate notifications.

6. Prohibited uses

You agree not to:

  • Use the Service for unlawful purposes.
  • Attempt unauthorized access.
  • Reverse engineer the Service.
  • Use bots or scrapers.
  • Resell access without permission.
  • Harass or harm others.
  • Submit fraudulent information.

7. Subscription and billing

Paid tier (launching Q3 2026):

  • Billed via Paddle (Merchant of Record).
  • Tax compliance handled by Paddle.
  • Auto-renewal unless canceled.
  • Cancel anytime in Account Settings.
  • Cancellation effective at the end of the period.

8. Intellectual property

The Service is the exclusive property of Startup58 LLC. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service per these Terms.

You may not:

  • Copy, modify, or create derivative works.
  • Reverse engineer.
  • Use our trademarks without permission.
  • Remove proprietary notices.

9. Disclaimers

The Service is provided "as is." We disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.

Case status comes from USCIS systems. We are not responsible for USCIS delays, errors, or inaccuracies.

10. Limitation of liability

To the maximum extent permitted by law:

  • Total liability is limited to the greater of: the amount you paid in the 12 months prior to the claim, or USD $50.
  • We are not liable for indirect, incidental, consequential, or punitive damages.
  • We are not liable for lost data, lost profits, or business interruption.

Some jurisdictions do not allow certain limitations.

11. Indemnification

You agree to indemnify Startup58 LLC from claims arising from your use of the Service, violation of these Terms, or violation of third-party rights.

12. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws principles.

For non-EU/UK users: disputes are resolved in Wyoming state or federal courts.

For EU/UK consumers: you may pursue legal action in your country per local consumer protection laws.

13. Changes to Terms

Material changes:

  • Email notification 30 days before effective date.
  • Active consent required before continued use.
  • Plain-language summary of changes provided.

Non-material changes:

  • Posted with an updated "Last updated" date.

14. Termination

We may suspend or terminate access for:

  • Terms violation.
  • Fraudulent or illegal activity.
  • Non-payment of fees.
  • Legal requirement.
  • Other reasonable cause.

You may terminate by closing your account.
